Public Notice: Proposed Permit for Sitka Wastewater Treatment Facility in Alaska

Requests for a public hearing must include the nature of the issues to be raised, as well as the requester's name, address and telephone number.

Comments must be received within the comment period to be considered in the formulation of final determinations regarding the application.

All comments should include the name, address and telephone number of the commenter, and a short statement of the basis of any comment and the relevant facts upon which it is based.

EPA is proposing to reissue a National Pollutant Discharge Elimination System (NPDES) permit to the City and Borough of Sitka wastewater treatment plant in Alaska.

The City and Borough of Sitka owns and operates the wastewater treatment plant, a publicly-owned treatment works serving the population of Sitka, Alaska. The treatment plant discharges primary treated effluent to Sitka Sound under a section 301(h)-modified NPDES permit.

EPA retains jurisdiction over Clean Water Act section 301(h)-modified permits in the state of Alaska as that portion of the NPDES program may not be delegated to the state.

The City and Borough of Sitka has requested renewal of the wastewater treatment plant's variance under Section 301(h) of the Clean Water Act from the secondary treatment requirements contained in Section 301(b)(1)(B) of the Clean Water Act, and reissuance of its 301(h)-modified NPDES permit.

The EPA Region 10 Regional Administrator has tentatively decided to renew the Sitka wastewater treatment plant's variance from secondary treatment requirements in accordance with the terms, conditions, and limitations of the draft 301(h)-modified NPDES permit. A 301(h) Tentative Decision is available for review and comment (see Related Documents below).

The Region 10 office of the EPA has tentatively determined to issue a 301(h)-modified discharge permit to the City and Borough of Sitka.

Under Section 401(a)(1) of the Clean Water Act, EPA may not issue a permit until the State of Alaska, through its Department of Environmental Conservation, grants or waives a certification in accordance with that section.

The Alaska Department of Environmental Conservation (ADEC) is accepting public comments on EPA's request for Clean Water Act Section 401 certification and on ADEC's proposed 401 certification for the Sitka wastewater treatment plant permit.
